Court Denies Cooper 4th Time On Elections Board

Roy Cooper - DeniedNorth Carolina Governor Roy Cooper had another bad week last week.

The Court of Appeals rejected the governor’s motion to delay a superior court panel’s order that he appoint members to the new bipartisan board.

This makes the fourth time the courts have blocked Cooper over his objection to the law passed creating a bipartisan state elections and ethics enforcement board.

Senate Leader Phil Berger (R-Rockingham) and House Speaker Tim Moore (R-Cleveland) issued the following joint statement:

“While Gov. Cooper attempts to sue his way out of following state law, North Carolina’s bipartisan elections and ethics board sits vacant with no accountable oversight of lobbying, ethics or campaign finance. Our state’s chief executive needs to listen to the courts, do his job and execute the law.”

The Governor’s office did not post an official statement about the decision on its website. No reaction was posted to the Governor’s official Twitter account either.

The second denial came three weeks ago from a 3-judge Superior Court panel who ruled against the governor’s request to stay the implementation of a law which creates a Bipartisan Elections and Ethics Board.

Cooper appealed and the court dismissed Cooper’s motion a third time, leading to Cooper’s latest motion for a stay.

This is the same 3-judge panel who earlier this month unanimously dismissed the governor’s lawsuit against the General Assembly over the creation of the Bipartisan Elections and Ethics Board.

The panel consisted of Judges Jesse B. Caldwell III,  L. Todd Burke and Jeffrey Foster.
